These Terms of Service ("Terms") govern your use of our website (evergreentruckservice.com) and the DPF cleaning, repair, and related services provided by Evergreen Truck and DPF Services LLC (USA) and Evergreen Truck DPF Services INC (Canada) (collectively, "Evergreen Truck Service", "we", "us", or "our").

By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our website or services.

1. Services Provided

Evergreen Truck Service provides specialized diesel aftertreatment services, including but not limited to DPF cleaning, DOC cleaning, SCR cleaning, EGR cleaning, turbocharger cleaning, and engine carbon cleaning. Services are offered both in-shop and via our mobile service units in applicable service areas across the United States and Canada.

2. Estimates, Pricing, and Payment

Estimates: Any estimate provided is an approximation of charges based on the initial assessment. Actual charges may vary if hidden damage or additional necessary work is discovered during the service process. We will seek your authorization before proceeding with work that significantly exceeds the original estimate.
Pricing: Prices are subject to change without notice. Applicable taxes will be added to all services as required by local laws (e.g., state sales tax in the US, HST/GST/PST in Canada).
Payment: Payment is due in full upon completion of services unless prior credit arrangements have been established. We accept major credit cards, fleet checks, and corporate accounts.

3. Service Warranties and Disclaimers

Workmanship Warranty: We stand behind the quality of our cleaning and repair processes. We warrant that our services will be performed in a professional and workmanlike manner.
Pre-Existing Conditions: We are not liable for pre-existing damage to DPF filters, substrates, engine components, or sensors. If a filter is found to be melted, cracked, or irreparably damaged prior to or during the cleaning process, you will be notified, and cleaning fees or diagnostic fees may still apply.
Disclaimer of Implied Warranties: To the maximum extent permitted by law, all services are provided "as is" without any implied warranties of merchantability or fitness for a particular purpose.

4. Limitation of Liability

In no event shall Evergreen Truck Service, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, loss of revenue, fleet downtime, or towing fees, arising out of or related to our services or your use of this website.

Our total liability for any claim arising out of the services provided shall not exceed the total amount paid by you for the specific service giving rise to the claim.

5. Customer Responsibilities

As a customer, you agree to:

Provide accurate and complete information regarding your vehicle's history, symptoms, and fault codes.
Ensure your vehicle is accessible and in a safe environment if utilizing our mobile cleaning services.
Acknowledge that overriding or deleting emissions systems is illegal, and Evergreen Truck Service strictly adheres to EPA and Environment Canada regulations. We do not perform or support emissions "deletes".

6. Website Use and Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Evergreen Truck Service or its licensors and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or modify any content without our express written consent.

7. Governing Law and Dispute Resolution

Depending on where the service was rendered or your primary place of business:

For United States Clients: These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.
For Canadian Clients: These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Any disputes arising out of these Terms or our services shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the exclusive jurisdiction of the courts in Gwinnett County, Georgia (for US claims) or the Regional Municipality of Niagara, Ontario (for Canadian claims).

8. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

9. Modifications to Terms

We reserve the right to revise these Terms at any time. Any changes will be effective immediately upon posting to the website. Your continued use of the website or our services constitutes your acceptance of the revised Terms.
